Fake news or misinformation is rampant nowadays, especially in social media. With just one click, people could spread malicious rumors and gossips about someone that could destroy someone's moral, socially, and emotionally. Unlike before, we have now the power to stop this, even to charge individuals who do this.
This is a warning for those people who enjoy spreading rumors on social media like Facebook. With that in mind, a female vendor in Cebu was sent to jail for allegedly disseminating rumors on Facebook messenger.
According to the news from a concerned Facebook user, the said woman is currently facing charges of cyber libel and has to pay P10,000 for her bail bond. She was caught in Bantayan, Cebu, who allegedly used the app to send deteriorating words to the victim.
In case you not aware, cyber libel is now considered a crime in the country under Article 353 of the Revised Penal Code of the Philippines, libel is defined as a public and malicious imputation of a crime, vice or defect, real or imaginary or any act, omission, condition, status or circumstance tending to discredit or cause the dishonour or content of natural or judicial person or to blacken the memory of one who passed away.
Cyber libel is under Republic Act No. 10175 or better known as Cybercrime Prevention Act of 2012. These are the four elements of libel:
1. Imputation of discreditable act or condition to another.
2. Publication of the imputation.
3. Identity of the person defamed.
4. Existence of malice.
Those individuals who will be proven guilty of spreading malicious or derogatory words to others or anything that falls under the Cyber Libel law can face up to 12 years of jail time. We hope that this will be a warning especially to people who make this thing there past time. Apparently, many netizens got scared.
